COVENANT & BY-LAWS
CHANGES VOTE APPROVED:
The PVC Board of Directors during the Regular
August Board Meeting approved four changes for an
owners' VOTE as proposed by the Rules &
Covenants Committee. The goal is to complete the
vote and have results for the September Board
Meeting. Ballots will first be distributed in the
Campground and then mailed to those owners not
contacted in person. Ballots are also available
electronically from this site. See below.
The Ballot presents the owners proposed changes
on four topics:
1) Approve 12 wide park trailers (models) for
PVC
2) Owners not voting no longer counted
in Covenant & By Law change voting
3) Vacant Board seat filled by Board
appointment not past un-elected candidate
4) Foundation post height increased from 2 to 3
feet
The Ballot spells out in detail the exact
changes to documents and includes a discussion of
what and why. The Committee received input from a
variety of folks. Ballots are to be returned to Jo
Roskosh Lot 41 in person or by mail to : PVCOA,
1000 Paradise Valley Rd #310, Cleveland, GA 30528.
Every ballot envelope must have the owners lot
number(s) on the outside of the envelope.
A variety of questions and comments were
presented at the Meeting when this VOTE was
presented. Two points came through loud and clear,
Paradise Valley is the only RV park within White
County that does not welcome 12 wide units and a
number of owners promoting this VOTE wish to have
one on their lot.

MOTE PERMIT RESCINDED, then,
JUDGE REVERSES RULING:
In
a technical ruling, a Georgia State Administrative
Hearing Judge found that Chris Mote's changing the
Applicant, from a Corporation to an LLC, during
the Permit Application period, requires, as a
matter of law, that the Issued Permit be
"reversed". An LLC may not hold such a
Permit. The Petitioners, appearing without legal
representation, included a number of Mote's
neighbors. It is unknown if Mote will pursue
further action in the matter. The ruling was
unrelated to the operation Mote proposed to run
under the Permit, but rather addressed what type
of entity might hold such a permit in the first
place. An Administrative Hearing is a first
step in a legal process that could next move to

The
July 8, White County News reports that Judge John
Gatto, who issued the ruling above, reversed his
ruling on June 30, after testimony from EPD
Director Allen Barnes revealed that there were
many EPD permits issued and in effect for years,
that had been granted to LLC's, without legal
challenge. This renders the technical argument
against Mote moot.
In
further developments, the several pending legal
actions against Mote were consolidated and the merits
of the various claims therein, will be heard in
future. Petitioners pin hopes of stopping Mote on
pollution claims.
It
seems this (legal) battle is far from
over.....

(72%) were voted (possible 289). There was a quorum
present at the Meeting.
US MAIL:
The United States Post Office has directed that we no longer use a postal address that includes
our campground box numbers. An example of an old address : 1000 Paradise Valley Road #97. We are
now to use our actual street addresses or 911 addresses. An example of a new address : 96 Big Rock Road. In many ways
this simplifies mailing since your lot location and mail address are now the same just as if you were located on a
typical residential street. The mail carrier will translate your
present campground box number so you will continue to receive
your mail in your campground mail box as in the past.
Contact the carrier or leave a note in your
campground box if you have not received your
written notification.
